NABL now accepts LLP as legal entity of CAB under the Limited Liability Partnership Act 2008

The National Accreditation Board for Testing and Calibration Laboratories (NABL) now accepts the “Limited Liability Partnership” as a legal entity of Conformity Assessment Body (CAB) under the Limited Liability Partnership Act 2008.

NABL has been established with the objective of providing Government, Associations and Industry in general with a scheme of CAB’s accreditation which involves third-party assessment of the technical competence of testing including medical and calibration laboratories, proficiency testing providers and reference material producers.

Limited Liability Partnership (LLP) is an alternative corporate business form that gives the benefits of limited liability of a company and the flexibility of a partnership. The LLP can continue its existence irrespective of changes in partners. It is capable of entering into contracts and holding property in its own name. The LLP is a separate legal entity, is liable to the full extent of its assets but liability of the partners is limited to their agreed contribution in the LLP. CABs which are partnership entities at present are required to register under LLP Act 2008 till December 31, 2023

NABL is accepting following legal entities as on date like One Person Company, LLP, Company, Society/ Trust and Government. CABs who are in the process of transition, may opt for LLP. In such cases CABs have to submit an undertaking that they will get themselves converted into LLP by December 31, 2023.

CAB needs to submit the documentary evidence for the compliance of the same to NABL.

NABL is an accreditation body, with its accreditation system established in accordance with ISO/ IEC 17011. “Conformity Assessment –Requirements for Accreditation bodies accrediting conformity assessment bodies.”

NABL provides voluntary accreditation services to Testing laboratories in accordance with ISO/ IEC 17025 ‘General Requirements for the Competence of Testing and Calibration Laboratories’, Calibration laboratories in accordance with ISO/ IEC 17025 ‘General Requirements for the Competence of Testing and Calibration Laboratories’, Medical testing laboratories in accordance with ISO 15189 ‘Medical laboratories -Requirements for quality and competence’, Proficiency Testing Providers (PTP) in accordance with ISO/IEC 17043 “Conformity assessment — General requirements for proficiency testing” and Reference material producers (RMP) in accordance with ISO 17034 “General requirements for the competence of reference material producers”.
